Conyers Dill & Pearman’s affiliate, Codan Trust Company (B.V.I.) Ltd., has been approved by the BVI Financial Services Commission as a registered trade mark agent.
The Trade Marks Act came into force on September 1, 2015. Under the new regime only registered trade mark agents may apply to register trade marks in the British Virgin Islands. Registered trade mark agents are required to have a substantial knowledge of trade mark law and professional competence, and we are delighted that Codan has qualified as a registered trade mark agent.
The new legislation modernises the trade mark system in the British Virgin Islands by allowing the registration of certification and collective marks, introducing mechanisms for priority filings, permitting protection for well-known marks and reducing the renewal term to 10 years. The new legislation aligns the British Virgin Islands with its obligations under international treaties.
