BVI Commercial Court Updates

The Registry of the Supreme Court has released an assortment of notices providing updates on the return of the BVI Commercial Court in January 2018 and the return of searches to a physical location.

Supreme Court Notice No. 14 of 2017 states the Commercial Division of the High Court will return to the BVI in January 2018.

Sittings of the Court will be held at the International Arbitration Centre on the 3rd Floor of Ritter House, Wickhams Cay II, Road Town, Tortola, until further notice.

His Lordship the Honourable Mr. Justice K. Neville Adderley (Ag.) will continue his tour of duty in January 2018, and His Lordship the Honourable Mr. Justice David Chivers QC (Ag) will sit during the period 1 January to 31 March 2018.

The Court has also advised it will shortly issue further directions with respect to the mode of filing and all relevant particulars.

Supreme Court Notice No. 15 of 2017 from Wednesday, 13 December 2017 searches can be conducted in person at the search desk at the Registry of the Supreme Court, second floor, Sakal Place, Road Town. 

This is a change from the, now discontinued, online search service which was created post Hurricanes Irma and Maria.

The applicable fee for searches conducted in person is $5 as brought into force by the Eastern Caribbean Supreme Court (Court Proceedings Fees) (Virgin Islands) Rules, 2017 (Statutory Instrument No 71 of 2017).
